Winzo Games files plea in Delhi HC to be listed on Play Store as game of skill

Indian online gaming platform Winzo Games has filed a petition with the Delhi High Court, requesting to be listed on the Google Play Store as a game of skill. The company argued that since the games it offers are skill-based and comply with India’s online gaming laws, they should be permitted to be listed on the Play Store. During the hearing of Winzo’s plea, the Delhi High Court asked the company’s legal representative to obtain fresh instructions since the government recently introduced new regulations for online gaming intermediaries.

Winzo Games has filed a suit in the Delhi High Court to challenge the biased policy on Play Store and AdWords, which allows only fantasy and rummy games. According to the statement, the company’s move is to get fair access to the market, and it seeks validation from a competent court for all its games such as trivia, chess, and carrom. A spokesperson for the company said the legal challenge was aimed at achieving a similar validation for all of its games.

The Ministry of Electronics and Information Technology recently released new rules for online gaming intermediaries, which state that an industry-led self-regulatory organization will determine which games can be offered to users. The organization will be made up of industry representatives and experts, and will have the authority to prohibit wagering or betting of any kind, as well as games that cause harm to consumers.

Online gaming firms, such as Dream11, InMobi, Gameskraft, MPL, Nazara Technologies, and WinZo Games, met with officials from the Ministry of Electronics and Information Technology and the Minister of State for Electronics and Information Technology, Rajeev Chandrasekhar, to clarify certain aspects of the new rules for online gaming intermediaries. The companies sought FAQs on topics such as gambling, betting, and wagering on the outcome of a game, as these are subject to state regulations. The meeting, which lasted approximately an hour, took place after the ministry released the new regulations earlier this month.
