SC agrees to hear Google’s plea against CCI penalty on January 16

The Supreme Court agreed on Wednesday to hear Google’s appeal against a ruling of the National Company Law Appellate Tribunal (NCLAT) that refused to stay a Rs 1,337.76 crore penalty imposed by the Competition Commission of India (CCI) for alleged anti-competitive practices on January 16.
A bench composed of Chief Justice DY Chandrachud and Justice P S Narasimha took note of senior advocate A M Singhvi’s submissions on behalf of the US firm and stated that the plea will be listed for hearing on Monday.
According to the senior lawyer, the Competition Commission of India (CCI) has issued extraordinary directions that must be followed by January 19.
“There is no finding of abuse of dominance,” he said.

Earlier last week, the NCLAT declined to stay the order of the Competition Commission of India (CCI), citing the fact that the order was issued on October 20, 2022, but the appeal was filed on December 20, 2022.
The NCLAT also ordered Google to pay 10% of the penalty amount within three weeks.
“Be that as it may, once order was passed in the month of October, had there been any such urgency it was expected that the appellant would have approached this tribunal forthwith. However, in this case no such urgency was shown in filing of the appeal and as such the appellant may not be permitted to insist for interim order, that too once we are giving a short date for final hearing of the appeal,” it said.
CCI fined Google Rs. 1337.76 crore in October last year for anti-competitive practices in relation to Android mobile devices.
