PhonePe takes BharatPe to court, moves Bombay High Court
In an ongoing dispute over the usage of the suffix ‘Pe’ in BharatPe owned PostPe’s name. PhonePe has moved the Bombay High Court on the matter. PostPe was launched earlier this month and marked BharatPe’s first foray into the buy now pay later (BNPL) domain.
The company said in a statement, “PhonePe sought an injunction to restrain Resilient Innovations i.e. BharatPe from misusing PhonePe’s registered trademarks by using and promoting the marks ‘PostPe’ / ‘postpe’.”
PhonePe has previously taken BharatPe to court for the usage of the aforementioned suffix in September 19. The Delhi High Court had ruled, however, that BharatPe was not in violation of the former’s trademark. PhonePe then proceeded to move the Delhi HC for a trial against BharatPe- which is ongoing till date.
Commenting on the trial held yesterday, the PhonePe statement said, “During the hearing, the HC observed that the mark PostPe adopted by Resilient Innovations is so phonetically, structurally and visually similar to PhonePe mark that he also thought that PostPe / postpe is a natural evolution of the word PhonePe and emanated from PhonePe.”
The case was withdrawn to address specific observations made by the Bombay HC and will be filed again, as per the company.
