AIGF and gaming companies file writs against Karnataka High Court gambling ban
The All India Gaming Federation (AIGF), Play Games24x7 Pvt Ltd (RummyCircle and My11Circle), Head Digital Works Pvt Ltd (A23), and Gameskraft Technologies Pvt Ltd (RummyCulture and Gamezy) have filed a writ petition in the Karnataka High Court against the Karnataka Police Amendment Act, 2021. The act was passed by the Karnataka Legislative Assembly in late September and included online gambling in the list of gambling activities prohibited in the state. The AIGF and other gaming companies have challenged the constitutional validity of the amendment as it has included in its purview wagering on games of pure skill- which was an exemption till last month.
The petitions reference a slew of High Court and Supreme Court rulings such as Junglee Games Pvt Ltd vs. The State of Tamil Nadu that nullified the state’s decision to prohibit all online games for stakes.
The petitioners have claimed that the prohibition is purely arbitrary, unreasonable, and vague and that it does not comply with the test of proportionality. They have also requested interim reliefs so as to not have their business activities be obstructed by the state’s law enforcement.
All four petitions have been acknowledged by the High Court and are awaiting final registration.
