Government to release draft e-commerce policy, rules soon

The Government of India is set to release its draft e-commerce policy as well as e-commerce rules within the next few weeks simultaneously in an attempt to combine synergies and reduce confusion. The e-commerce policy and rule consist of comprehensive guidelines covering multiple aspects such as provisions for ride-hailing companies, ticketing and payment companies, food delivery apps etc.
While the e-commerce policy will be drafted and presented by the Department of Promotion of Industry and Trade (DPIIT) under the Ministry of Commerce which will in turn address gaps in the digital commerce policy as well as lay down the conventional rules for online trading. On the other hand, the Ministry of Consumer Affairs, Food and Public Distribution have been entrusted with the task of drafting and releasing the e-commerce rules which would govern the consumer interest.

Both these departments have released their drafts in the past but they were not in perfect synchrony with one another and created misunderstandings for the general public also leaving behind unaddressed gaps.
The latest draft policy and rules to be presented by both rules are expected to focus on setting up of a regulator, thus framing a comprehensive e-commerce law and penalties for violation. While the earlier draft majorly focused on data for development of industry by Indian and foreign funded companies, the recent draft would focus on the e-commerce guidelines for all domestic as well as foreign funded startups.
