“The petitioner (Godrej & Boyce) categorically denies that it is responsible for the alleged additional expenditure of Rs. 1,000 crore or any part thereof. Significantly, no data or material has been placed before the court to prove this ‘false’ allegation. In the admitted absence of any data or material to substantiate the alleged extra expenditure of In its submission made on January 2, Godrej & Boyce said, “In the matter of Rs 1,000 crore or any part thereof, the matter can only be termed as a red herring in an attempt to prejudice the court.” The legal battle over the acquisition of the land and its compensation has been going on for more than three years.

Godrej & Boyce stated that it has filed a detailed response to the government’s claim that it is barred from contesting the land acquisition. Godrej & Boyce cannot contest the acquisition of the land in question; the government stated that the only issue it can raise is the amount of compensation. The company claimed that it had the right to defend its constitutional and legal rights. The company responded to the state government’s submissions by stating that it was not only offering compensation, but was also contesting the land acquisition itself.
