Delhi High Court Directs Ashneer Grover and BharatPe to Refrain from Using Defamatory Language

The Delhi High Court expressed dissatisfaction with the language utilized by former BharatPe MD Ashneer Grover and Bharat Pe during their dispute, advising them to refrain from using defamatory language.
The Delhi High Court, while issuing notice on Bharat Pe’s plea, expressed its dissatisfaction with the language employed by Grover and Bharat Pe, urging them to refrain from using unparliamentary and defamatory language.
After the Delhi Police registered an FIR against Ashneer Grover and his family, the fintech company approached the High Court, accusing Grover of making allegations against the company on Twitter.
In this regard, Justice Jalan expressed his displeasure and said, “This is not a street fight between some rival gangs in the corner of the city. These are corporate people, educated people, articulate people who can surely adjudicate their grievances against each other more refinedly.”
“If you have both decided to enter the gutter, then please remain there,” he added. The counsel representing Grover accepted the notice on behalf of all respondents. The bench set a deadline for filing a reply by May 20 and a rejoinder by May 22. Justice Prateek Jalan issued the notice to Ashneer Grover, the former MD of Bharat Pe.
The case has been scheduled for hearing before the roster bench on May 24. In a previous hearing of the defamation case in January 2023, the Court had also advised Grover’s counsel to ensure that he maintains decorum.
Representing Bharat Pe, Senior Advocate Rajiv Nayar and Dayan Krishnan referred to Grover’s tweets, claiming that they were defamatory in nature. They argued that if Grover had any issues with the FIR, he should challenge it in court.
Advocate Giriraj Subramanian, representing Grover, pointed out the tweets made by officials of Bharat Pe. He argued that the company’s officials used similar language against Grover on social media and made allegations against him in the press. The Delhi Police registered an FIR on May 10, 2023, accusing Grover, his wife, and other family members of misappropriation of funds. The company has claimed a loss of approximately Rs 81 crores.
